High Court refuses to stay AirAsia flying permit
New Delhi: The Delhi High Court rejected to stay grant of flying license to new airline AirAsia India by aviation regulator Directorate General of Civil Aviation. A bench consisting of Chief Justice G Rohini and Justice Pradeep Nandrajog disposed of the application filed by Federation of Indian Airlines (FIA). The court said that there is no urgency as the flying permit will be subject to the outcome of the petition challenging the approvals being granted to AirAsia India deal.
The next hearing of the matter was fixed for July 11. “There is no urgency. The Air Operator’s Permit or flying license granted will be subject to the outcome of the writ petition. The application is disposed of accordingly. Just because the situation has changed a little bit does not mean a fresh cause of action has to be initiated,” said the court. AirAsia India was granted the flying license by DGCA on May 7.
Earlier, AirAsia India’s CEO Mittu Chandilya had earlier said that in about two to three months, they would be launching flights. He had also said that soon they would be filing our flight schedules for approval from the DGCA after which they will be seeking slots at the different airports. On Thursday, the high court had agreed to hear FIA’s plea challenging grant of flying license to AirAsia India by DGCA.
