Dissolving Assembly only option: Ministry of Home Affairs
New Delhi: The MHA officials said that the third option to break any logjam that may arise out of the deadline for the ratification of the President’s Rule in AP by Parliament expiring April 30, is to dissolve the Assembly, which is presently in suspended animation and allow Assembly elections to be held in the state as per schedule.
The Assembly elections in AP are being held along with the Lok Sabha polls. Here, the A-G is examining whether such a move is legally tenable as previous cases have shown that the Assembly can only be dissolved once the central rule is ratified, sources said.
“We are also open to the idea of a fresh way out apart from what is being considered right now,” an official said.
On March 26, the AP Governor had written to the Union Home Secretary Anil Goswami bringing to his notice the emerging situation and asked the central government to take a view on the continuation of proclamation of President’s rule in the state beyond April 30.
President Pranab Mukherjee had issued the proclamation for imposing President's rule in AP on March 1 which needs to be ratified by April 30.
