Andhra Pradesh High Court bench refuses to stay polls

The court pointed out that there was no prima facie to put a stay on the elections

Hyderabad: A division Bench comprising Chief Justice Kalyan Jyoti Sengupta and Justice P.V. Sanjay Kumar of the AP High Court on Thursday declined to put a stay on the Assembly and Lok Sabha elections in AP. The Bench dismissed a plea by D.Y. Das, Congress MLA of Pamarru constituency in Krishna district seeking an interim order to stay the elections.

The Bench admitted the main plea of the petitioner that challenged the elections to Assembly and Lok Sabha seats in united AP and then allotting the elected MLAs to another state which would come into existence at a later date. The court pointed out that there was no prima facie to put a stay on the elections, the Bench said that the polls should go on as per schedule and the main plea of the petitioner would be heard at a later stage.

Senior counsel D. Prakash Reddy, representing the Election Commission, argued that the AP Reorganisation Act would not come in the way of the ensuing polls and that the Section 19 of the Act (Central Act No.6 of 2014) provided for allotment of a sitting member of the Legislative Assembly of the existing state of Andhra Pradesh to the state of Telangana.

He said the petitioner’s right would not get affected due to the Commission’s decision to conduct polls in the state.
