Chief Secretary has judicial stigma, says High Court
Hyderabad: Referring to Supreme Court’s remarks against chief secretary P.K. Mohanty, in Umesh Kumar and Dinesh Reddy’s case, Chief Justice Kalyan Jyoti Sengupta on Thursday pointed out that “it appears that the chief secretary has judicial stigma”.
Justice Sengupta was hearing two petitions along with Justice Sanjay Kumar challenging extension of service of Dr Mohanty by Mr Chandramouliswar Rao and Consumer Guidance Society represented by Mr Diwakar Babu.
The state government had filed an affidavit defending the extension granted to Dr Mohanty. It told the court that it has sought intervention of the Governor as there was intimation from the then caretaker Chief Minister expressing inability to deal with such issues, and the recommendation was made by the Governor to extend his tenure.
The government said that the Governor informed the Centre that the state is at a critical juncture having to cope up with many complex issues relating to formation of a new state and had very tight time frame under which these processes have to be completed in an objective and impartial manner. The governor further told the Centre that the administration of the state which is already working under severe constraints will lose momentum and direction with the superannuation of the CS.
