Samsung, Apple still fail to settle
In yet another opportunity, Apple Inc. and Samsung Electronics Co seem to fail to resolve their dispute over their current spat. The two tech giants told a judge failed again to settle their dispute over the smartphone technology and their next trial in the federal court in California is all set to begin March 31.
According to Bloomberg, Apple CEO, Tim Cook, Samsung mobile chief, Shin Jong-Kyun, and few other executives from both firms attended the full-day session with the mediator early February. Thereafter, representatives from both sides had numerous follow-up phone calls with the mediator; a joint status report filed late stated yesterday.
“Notwithstanding these efforts, the mediator’s settlement proposal to the parties was unsuccessful,” Apple, and Samsung said in their report to San Jose, the US District Judge. Jose had urged them to pursue settlement talks before the actual trial. “Parties remain willing to work through the mediator jointly selected by the parties.”
The top smartphone makers have spent millions of dollars in the legal fees and court cases. The two claim copying each other’s features in order to dominate the market.
“Even though Apple seems to be winning across the board” in courtrooms, “they’re not winning in the marketplace,” Mark A Lemley, professor at Stanford Law School, said in an interview before the report was filed. Verdicts, rulings and even court orders “don’t seem to be slowing Samsung’s momentum very much,” he added.
