The 22-year-old youth raped his friend's sister.
New Delhi: A youth has been sent to 10 years in jail for kidnapping and raping his friend's 12-year-old sister by a Delhi court which refused to show any leniency to him.
The court awarded the jail term to 22-year-old Sandeep, a resident of Sultanpuri here, for the offences of kidnapping, rape and criminal intimidation and also imposed a fine of Rs
11,000 on him.
"The proximity which the convict was enjoying with the family of victim not only gave him a free access to her house, but also kept him well informed about movement/presence of her
other family members, thus making the child a vulnerable victim.
"Keeping in view the serious allegations against the accused, he is not entitled to a lenient view by taking plea that he being the sole earning member, is required to discharge his responsibility towards his younger sisters, brother and other family members. In my opinion, convict is not entitled to any leniency," Additional Sessions Judge Illa Rawat said.
According to the prosecution, Sandeep, who was working as a cook at an Anganwari here, had come to the victim's house in February 2012, and took her with him on the pretext that her friend was calling her urgently.
He took a different route and told the minor that they will go to her friend's place from a different direction. He, however, took her to a room behind a school in the area and raped her, it said.
When the girl tried to raise an alarm, he gagged her and also threatened her not to disclose the incident to anyone.
During the time when Sandeep had confined the minor, her brother called at his mobile phone several times and he also attended the call.
The last call was attended by the girl who told her brother that she has been confined by the youth in a room and gave her the description of the place after which she was rescued, the police said.
Sandeep was caught and was handed over to police.
The court noted that Sandeep, being a friend of the minor's brother, was known to her and he won over her confidence.
He had carefully planned his visit to her place at a time when her parents had gone to their village and elder brothers had gone to market and she was in the house only with her aged grandmother and younger brother, it said.
