Computer firm told to refund customer

Malfunction of computer drove the customer to file a petition before the forum.

Chennai: The district consumer disputes redressal forum, Chennai (south) has directed a computer company and its agency to refund Rs 26,000 to a consumer for selling an assembled computer which malfunctioned repeatedly.

The bench, comprising president Jayabalan and member L. Deenadayalan, directed the company to release the amount in two months.

In the petition, M. Magendran of Tondiarpet submitted that he purchased a personal computer from Modern Computers, Tiruvottiyur, a branch of Modern Computers, Anna Salai, for Rs26,000 on June 16, 2011.

The configuration of the computer includes Core 2 duo Intel, 4 GB Ram, 500 GB Hard disk, DVD writer, Samsung monitor, UPS, mouse and Umax speaker.

Soon after purchasing, the computer malfunctioned. On information, a service engineer from Modern Computers, Anna Salai, repaired it. The system developed problem four times after that. The service engineer would fix the system repeatedly on information.

However, since February 2012, the computer was not functioning properly. He served notice to the company and its agency.

As there was no reply, he filed the petition before the forum seeking a direction to respondents to pay a compensation of Rs 2 lakh for causing mental agony to him and deficiency in service.

As the company and its agency were not represented, the forum delivered its ex parte verdict.

The bench directed the company and its agency to refund Rs 26,000 to Magendran and directed them to also pay a cost of Rs 1,000 to him.

The bench directed Magendran to return the malfunctioning computer through the forum.
