Nariman tells Jagan to debate separation
Nariman advises YSRC chief that he may lose chance to move SC against Telangana.
Hyderabad: The YSR Congress legislators will most probably not only participate in the debate on the Telangana Bill when it resumes on January 17 but will also vote against the state’s bifurcation.
Sources said that noted legal luminary F.S. Nariman has advised YSRC chief Y.S. Jagan Mohan Reddy that by not debating and voting on the Bill, the party might lose the opportunity of approaching the Supreme Court against bifurcation.
Jagan Mohan Reddy had earlier told his MLAs and the public that it was a waste of time to participate in the Telangana Bill debate as it would be construed that mere participation was tantamount to agreeing to the division of state and had asked his legislators to either boycott or get suspended from the House.
However, the YSRC chief had sought a legal opinion from the office of Nariman, which has advised him to participate in the debate.
The correspondence that the YSRC has received from Nariman’s office states: “Your participation in the division debate is very much required at this hour for two reasons. 1.
- The Congress, Telugu Desam and the TRS may target your party at an open platform of Assembly and may accuse that your people are responsible for division and that you are pro-division and that is the reason your party is scared to participate in the discussions. Mr Nariman said it was important that YSRC?MLAs start a discussion against bifurcation of the state on the floor of the Assembly.
- If the YSRC representatives fail to participate in the debate you may also lose the opportunity to challenge the same in the Supreme Court. There is a chance that the court may ask you why your party had not availed the opportunity to discuss the Bill at the Floor and whether the majority of members had requested for a united state or not.
?“Being the frontrunner in challenging the Cabinet resolutions regarding the formation of Telangana, it is important for all subsequent challenges in the Supreme Court with respect to the formation of Telangana, that we are seen as participating in the institutional and consultative processes in the Constitution with respect to a formation of a new state from the existing state of Andhra Pradesh.
The party and its stand has to be emphatically registered in the Legislative Assembly to make any viable challenge to Telangana in terms of Article 3 of the Constitution.
Participation in a discussion on state formation initiated by His Excellency, The President of India is an integral part of the Constitutional process of state formation as per Article 3 of the Constitution.”
It also stated: “It is important to note that any of the members of your party has to start the discussion in the floor with ‘against to the bifurcation of the state for the well-being of the state’s development’ and should end with the same.”
