Chennai: Delivering a strong rebuttal to the allegations made by DMK leader Karu­nanidhi that the AIADMK government was choking the lifeline of social justice by not following reservation policy with reference to recruitment of staff for the Super Specialty hospital at Omandurar Estate, Chief Minister Jayalalithaa said on Sunday that state governments could not ap­p­ly reservation policy for the recruitment of medical staff for super specialty hospitals in view of a Supreme Court judgment.

The advertisement issued by the state government had stated that medical professionals would be appointed at the hospital on deputation and on a contract basis. “Reservation cannot be applied to medical professionals who will be deputed at the hospital as they have already been recruited following the reservation policy. As for contract employees who would be hired, reservation would not apply based on the existing laws as on date,” the Chief Minister said in a release.

Elaborating on the state government’s stand, CM said that a judgment delivered by the Supreme Court on July 7, 2013 in the case between the Indian government and Faculty Association of AIIMS had clearly stated following reservation for recruitment in super specialty hospitals and certain other specialised scientific organisations would not be right.

Jayalalithaa also pointed out that the previous DMK government too had recruited over 540 employees for Tamil Nadu AIDS Control Society, Revised National Tuberculosis Control Programme, Tamil Nadu Hygiene Programme and State Welfare Society, without applying reservation policy on contract basis.
