Child abuse: Out-of-court deal flayed
Thiruvananthapuram: The recent High Court decision to dispose of a child abuse complaint citing an out-of-court settlement is seen as turning the clock back on the fight against sexual abuse.
The case related to the sexual abuse of a 14-year-old boy by four men, all of them aged between 21 and 27.
The alleged offence was punishable under section 377 of the Indian Penal Code and section 3(a), 7 and 8 of Protection of Children from Sexual Offences Act, 2012.
“The cases normally charged under section 377 of the IPC, which deals with unnatural offences, are non-compoundable and, therefore, cannot be settled out of court,” said lawyer J. Sandhya of Human Rights Law Network.
Moreover, in most of the cases, the victims do not have a level-playing field. “Most of these victims are from poor and weak backgrounds,” Sandhya said.
"The perpetrators can easily force them to toe their line using threats or money,” she said.
Activist and author P. Geetha said that the courts should not give time for the parties to arrive at an out-of-court settlement.
“If the issue could have been settled outside, then it should not have been brought to the court in the first place,” Geetha said. According to her, the decision to quash a child abuse case citing outside settlement is absurd. “It is as outlandish as saying that all wrongs will be righted if the rapist agrees to marry the victim,” she said.
Dr Seema Bhasker, national mission manager of National Rural Livelihood Mission, pointed out the dichotomy in the implementation of section 377 of the IPC.
“After the Supreme Court verdict, it is illegal for even consenting adults to indulge in homosexual acts. But in the case of a wronged child, the law seems to have been applied in the most lenient manner,” Dr Bhasker said.
