In major setback to TD MLA Suman Rathod, the AP High Court on Tuesday.

Hyderabad: In major setback to TD MLA Suman Rathod, the AP High Court on Tuesday up-held an order of the Adilabad district collector who ruled that she was not entitled to the social status certificate of a Scheduled Tribe.

Dismissing a petition by the MLA challenging the order, the judge held that the court did not find any illegality or infirmity in the orders.

The then collector Ahmad Nadeem had quashed the caste certificate of the MLA of Khanapur reserved for ST in October, 2009 after an inquiry into a complaint questioning Rathod’s caste by the Thudum Debba (Adivasi Hakkula Porata Samiti). Rathod had contested twice as MLA on a TD ticket from Khanapur.

The collector in his report stated that Rathod was a native of Maharashtra and belongs to the Lambada community that is considered a Backward Class (BC) Community in that state.

Rathod challenged the order in the AP High Court. A single judge granted interim stay on the orders of the district collector cancelling her caste certificate of on October 22, 2009.

While pronouncing the final verdict, Justice Naveen Rao said that the court had earlier ruled in an election petition that the petitioner was not entitled to the said certificate and that the district collector had considered all aspects before passing the order.
