Supreme Court can’t do anything, Ganguly is retired citizen: Chief Justice of India
Chennai: Chief Justice of India P. Sathasivam on Thursday said the SC administration cannot interfere in Ganguly issue.
Speaking to reporters on the sidelines of a convocation function in the city, the CJI said post-retirement, a judge was considered a normal citizen and therefore it was up to the person concerned to proceed further.
On Ganguly’s resignation as West Bengal Human Rights Commission chairman he said it was for the retired judge to decide.
Meanwhile, the government appeared to be moving towards making a Presidential Reference for removal of Justice A. K. Ganguly as head of the West Bengal Human Rights Commission in the wake of his indictment by a Supreme Court committee for “unwelcome behaviour” towards a law intern.
The law ministry and the home ministry are learnt to be in agreement that prima facie a case can be made out against the former Supreme Court judge, sources said here.
The matter has now been referred to Attorney General G. E. Vahanvati to work out legal details.
