Unfair admission: NIMHANS told to compensate aggrieved candidate

The High Court has ordered National Institute of Mental Health and Neuro Sciences.

Bangalore: The High Court has ordered National Institute of Mental Health and Neuro Sciences (NIM­HANS) to pay Rs 25,000 as compensation to a MBBS graduate, who despite being eligible lost his seat in Post-Graduate Super Specialty course in M.Ch. Neuro Surgery to another candidate. The court also ordered the successful candidate to pay a nominal compensation of Rs 5,000 as damages to the MBBS graduate.

Justice Anand Byrareddy passed the orders on a petition filed by Dr Rakesh A.V. seeking directions to NIM­HANS to provide admi­ssion to him to M.Ch Cou­rse under MBBS category, considering his merit at serial No.3, instead of another candidate who is a post graduate and not eligible for admission, in accordance with notice issued prior admission to the course.

The petitioner had completed his MBBS from the Karnataka Institute of Med­ical Sciences, Hubli, in 2010 and had applied for Post-Graduate Super Spe­cialty course in M.Ch. Neuro Surgery through NIMHANS under the All-India Entr­ance Exam­ination conducted by it.

“While holding that the petitioner has been unfairly deprived of a certain admission to the course which he has been unable to achieve after a further attempt made by him, it is appropriate that he is compensated by a nominal damages. Consequently, NIMHANS shall pay a sum of Rs 25,000 and successful candidate shall pay a nominal sum of Rs 5,000 as damages to the petitioner, which they shall remit within January 2, 2014,” said the court order.
