Unfair admission: NIMHANS told to compensate aggrieved candidate
Bangalore: The High Court has ordered National Institute of Mental Health and Neuro Sciences (NIMÂHANS) to pay Rs 25,000 as compensation to a MBBS graduate, who despite being eligible lost his seat in Post-Graduate Super Specialty course in M.Ch. Neuro Surgery to another candidate. The court also ordered the successful candidate to pay a nominal compensation of Rs 5,000 as damages to the MBBS graduate.
Justice Anand Byrareddy passed the orders on a petition filed by Dr Rakesh A.V. seeking directions to NIMÂHANS to provide admiÂssion to him to M.Ch CouÂrse under MBBS category, considering his merit at serial No.3, instead of another candidate who is a post graduate and not eligible for admission, in accordance with notice issued prior admission to the course.
The petitioner had completed his MBBS from the Karnataka Institute of MedÂical Sciences, Hubli, in 2010 and had applied for Post-Graduate Super SpeÂcialty course in M.Ch. Neuro Surgery through NIMHANS under the All-India EntrÂance ExamÂination conducted by it.
“While holding that the petitioner has been unfairly deprived of a certain admission to the course which he has been unable to achieve after a further attempt made by him, it is appropriate that he is compensated by a nominal damages. Consequently, NIMHANS shall pay a sum of Rs 25,000 and successful candidate shall pay a nominal sum of Rs 5,000 as damages to the petitioner, which they shall remit within January 2, 2014,” said the court order.
