Life convict allowed to meet ailing mom
Madras High Court directs central prison to give leave to life convict ti see ailing mother.
Chennai: The Madras High Court has directed the superintendent of central prison, Puzhal, to release a life convict on emergency leave for five days to enable him to be with his mother, who will be undergoing operation for cancer on November 30.
Justice K. K. Sasidharan gave the directive while disposing of a petition from M Ananda Sri, wife of life convict Magesh.
According to the petitioner, her husband’s mother Jeeva Rathinam was affected by cancer and the doctors have advised to undergo operation. Hence, the petitioner submitted an application to the prison authorities to grant 30 days leave to the life convict, to enable him to be with his mother. However, the authorities did not consider the application, she added. Government advocate submitted that the life convict has exhausted all the leaves available to him and as such, it was not possible to grant leave.
The judge said there was no dispute that Rule 6 of the TN Suspension of Sentence Rules, permits the jail authorities to grant emergency leave to the life convict in case of serious illness of father, mother and wife. The only condition was that the person should be a near relative. Since, the mother of the life convict was in a serious condition and taking into account the fact that she has to undergo operation on November 30, necessarily emergency leave should be granted, the judge added.
