Sexual assault: Correspondent’s hubby in trouble

Karaikal (Puducherry): More than a month after the husband of a correspondent of a private school in Karaikal was accused of sexually assaulting a class IX girl, an enquiry committee of the district administration has established prima facie evidence and has forwarded the report to the judicial magistrate II to take action against the accused.

According to official sources, the district administration received a complaint from people and several political parties that S. Mahalingam, husband of M. Chandra, correspondent of Vinith School, Thirunallar, had sexually abused a class IX girl who had studied in the school.

The victim drank kerosene and underwent treatment at a community health centre in Karaikal, and subsequently obtained a transfer from the school.

“An enquiry committee constituted to go into the incident established a prima facie case of evidence against M. Mahalingam that he had sexually harassed and assaulted the girl. As per the Protection of Children from Sexual Offences Act, 2012, any physical contact with sexual intent (sexual assault as in Sec 7) is considered as a sexual assault on a minor girl child."

"The enquiry report has been forwarded to the judicial magistrate II to take cognizance of the offence and for further proceedings in this case,” District Collector A. Muthamma said.

The territorial administration has not designated a special court for hearing cases under the Protection of Children from Sexual Offences Act. This process may take some time, she added.

“The next natural consequence is to arrest the accused. The territorial government can consult the Madras HC and designate a special court to try the offence,” said Dr. S. Anandkumar, team builder of the Karaikal chapter of India against Corruption.
