Should women be forced to marry their oppressors? What problem does it solve?

If a woman has to marry the rapist, it is a boon rogues in the society. All he needs to do is propose to a girl of his choice and threaten her she would be raped if she does not accept his proposal because eventually she will have to marry him.

According to me marrying the oppressor increases the ongoing crime percentage. So I completely disagree with the idea of laws to marry the rapist. This won't guarantee a secure life for the victim.

Marrying a rapist amounts rapes every day and rapes life long. Hence it should be discouraged by all means and a minimum of capital punishment should be awarded to rapists. Any attempts to marry of a victim to the rapist would not encourage the rapists but also discourage the victims to approach legal agencies for redressal because even a person no less than the Cheif Justice of India suggests the victims to marry the rapists. It is unfortunate that people sitting in such high offices have this kind of misjudgement.

This opinion of Chief Justice is the manifestation of misunderstanding about the definition between rape and relationship cheating. In India it is common for girls to allege rape after having consensual sex. In many cases the girls withdraw their allegation of rape after monetary settlement or marriage with him. In India laws defines relationship cheating as rape and and men who indulge in consensual sex is hounded as rapists if the women claims it is against her wish! Pseudo women empowerment groups use is as tool to extort money in the name of women! The CJi should clarify that the girls who claims relationship cheating should be given the option to marry her consensual partner. Otherwise asking a girl to marry her rapist is barbaric and insensitive.

With all due respect to the Chief Justice, I disagree with him in principle. Though he is trying to think about the welfare and future of the victims in proposing this, it will in turn pave way for all anti-social elements to get girls to marry them, who otherwise wouldn't even want to look at them cos once they force themselves on a person beyond their reach then not only they can get away with the crime but also get to marry the girl. How many cases we have not seen in the past few years where guys throw acid on the girl or threaten / kill the girl if she doesnt agree to marry them ? By proposing this move we are giving them a better alternative to force the girl. If this gets approval from the law then if any girl is raped she will be forced by everybody to marry the guy who ruined her life. In my opinion this will be very negative move, a crime should get the punishment it deserves and not given alternate options for criminals.

Once the crime has been clearly established by the court of law, the guilty (rapist) shall recieve the heaviest penalty and also be jailed for life or hanged to death. He has taken away from a innocent women, their dignity and right to live respectfully, for a act of extreme cruelty. How can society imagine of marrying these traumatised girls to their oppresors? Are we opening gates to a new way of choosing wives/brides ?
