The Supreme Court on Wednesday permitted Essar and Loop promoters to file applications for transfer of their petitions in the 2G case to the top court from the Delhi high court, which had reservation on hearing their plea against the summons issued by special judge after CBI had chargesheeted them.
Essar promoters Anshuman and Ravi Ruia’s counsel Harish Salve raised the question on special judge O.P. Saini’s jurisdiction to take cognisance of the chargehseet when it does not contain any charge under the Prevention of Corruption Act. Mr Salve told a bench of Justices G.S. Singhvi and S.J. Mukhopadhaya that the CBI has only mentioned the charge under Section 420 of the IPC, which deals with the offence of cheating, against Essar-Loop promoters.
