Have powers to remove Chinnasamy: O Paneerselvam

EPS & OPS find his misconduct including financial irregularities'.

Chennai: Pointing out certain misconducts including financial irregularities committed by former MLA, R. Chinnasamy, O. Paneerselvam, coordinator of AIADMK party, informed Madras high court that being the administrative head of the Anna Thozhir Sanga Peravai as per the Constitution of AIADMK by-laws, the coordinator and joint coordinator of AIADMK removed him from the post of the Federation Secretary of ATSP.

Paneerselvam said this in his counter affidavit filed in response to the suit filed by Chinnasamy challenging his removal from the post of secretary of ATSP.
Justice C.V. Karthikeyan posted to April 3, further hearing of the suit.

In his counter affidavit, Paneerselvam submitted that the ATSP was one of wings of the AIADMK party.

The said wing was functioning under the total control and administration of the Coordinator and Joint Coordinator of the AIADMK party as per its byelaws.

The members of the central organisation (working committee) including the federation secretary of ATSP were appointed only by coordinator and joint coordinator of the party. He and Edappadi K. Palanisamy being the coordinator and joint coordinator of the AIADMK party have powers to remove members of the Central organization.

He said Chinnasamy was appointed as a federation secretary for five years and the said period was already over. Further, powers and functions of ATSP were entrusted to a three-member committee to look after the affairs of ATSP.

In addition, one more member was appointed in the existing committee with the charge of convener of the committee and the existing committee was looking after the affairs of ATSP.

The affairs and administration of ATSP was under the control and jurisdiction of the coordinator and joint coordinator of AIADMK. Therefore, the suit was not maintainable, he added.

He said Chinnasamy was facing charges of financial irregularities as well as misconduct in the affairs of ATSP.

If any interim order was granted by this court, the same will cause prejudice to the organization thereby causing hardship in so far as the recovery of the amounts misappropriated by him, he added and sought to dismiss the suit with exemplary cost.
