State CPM backs Pinarayi Vijayan on UAPA against students

THIRUVANANTHAPURAM: The CPM state leadership on Friday decided not to intervene in UAPA sections invoked by Kerala police against Allan Shuhaib and Thaha Fasal who were arrested by police in Kozhikode recently.

The decision was taken at the CPM state secretariat meeting held at the AKG Centre here. The secretariat came to the conclusion that it would not be proper to intervene in the case at this stage especially when the police is claiming to have acquired incriminating evidence against the duo.

The state leadership has also taken into account the opinion of Kozhikode district committee which had carried out a preliminary inquiry into the alleged Maoist links of the two youths. Though the district leadership believes there is evidence to suggest that the two CPM workers have Maoist connections, the state unit does not want to take unilateral action like suspending or expelling them from the party at this stage.

The secretariat decision comes a day after former CPM general secretary Prakash Kart asking the government to undo the wrong committed by the police in clamping UAPA. I think the police have wrongly utilised the Act. I am sure that the government will step into to do the needful and undo this mistake,” he had stated.

A statement issued by the Secretariat after its meeting said; “The government has made it clear that in Panthirankavu case a free and fair inquiry would be conducted without misusing UAPA.”

It said the UAPA is against Federal principles. The Left government is trying to approach the law with a democratic view within this limitation.

It said the current attempt was to weaken the LDF Government and the CPM which are working for the welfare of people.

This is the reason why certain sections are trying to twist the facts and spread falsehoods to create confusion in the minds of people.

“There is an attempt to create a unity of all anti communist forces and create confusion among the Left thinking people. In order to expose their designs and explain the party position on the issue, the secretariat called upon the party units and members to organise comprehensive peoples campaign,” it said.

The secretariat said the right wing and ultra left groups were attempting to weaken the LDF Government in the name of UAPA and Maoist issue. The party has directed all its units and members to run a sustained campaign on the issue among the people.

“Maoists have always tried to carry out disruptive activities in states which are ruled by the Left. The Maoists were part of the mahagathbandhan formed by Mamata Banerjee to bring down the Left Front Government in Bengal. The Maoists had publicly announced that they would physically eliminate the then Bengal chief minister Buddhadeb Bhattacharya and would go to any extent to make Mamata Banerjee the CM. In this context the activities carried out by the Naxalites to weaken the 1967 United Front Government is also relevant,” the party said.

The secretariat said the Maoists who are adopting a stringent position against the Left forces and CPIM is not a communist party which is following Marxist Leninist principles. “It is a terrorist outfit. Instead of a democratic political transformation they are advocating armed uprising. The experience shows that the Maoists policy of annihilation is not against class enemies but for attacking progressive organisations like CPIM and giving an opportunity to the opponents to weaken the Left organisations,” the CPM said.

It said Maoists have killed ordinary people including CPIM activists . The Maoist ideology has been rejected by modern Kerala.

The party said the police has made it clear that Maoists were killed in an encounter in Attapady after they attacked the police party. However, because of difference of opinion on the matter the government had announced a magisterial probe.

CPM’s well stated position on UAPA is that it is a draconian law which can never be accepted in democratic setup and it’s an assault on the rights of citizens. It was only the Left which had registered a strong protest within and outside Parliament when the UAPA and the amendment to the Act were brought.

However, the law which was brought by Congress and BJP joining hands is now applicable across the country. This law gives the legal right to Centre to intervene in law and order which was a state subject.
