The company contended that it had delivered al articles as per the complainant's directions.

Hyderabad: The consumer forum rapped Agarwal Packers and Movers, based in Secunderabad, and ordered it to compensate a city resident Milan Kumar Barnwual as some items that he had sent for delivery were missing.

Mr Barnwual, a resident of Himayathnagar, complained that he had paid Agarwal Packers to transport some goods from Gyanpur to Hyderabad on May 29. On delivery, he found a 32-inch Sony LED TV and one mattress were missing.

He told the forum that Agarwal Packers paid no heed to his repeated complaints. He had purchased the TV set only two months earlier.

The company contended that it had delivered al articles as per the complainant’s directions. It said Mr Barnwual had booked the consignment of 44 household articles for Rs 40,000 to be delivered to the Indian Bank Officials Quarters in Begumpet. He had specifically asked for insurance coverage for the delivery. Documents presented by both sides show that although Mr Barnwual had paid a premium at 3 per cent of Rs 29,000 claim was not settled by the carrier. The complainant was also denied the right to issue an insurance policy during the time of booking the consignment. Out of the 44 articles booked, Mr Barnwual said he received only 42.

The forum noted Agarwal Packers did not make any effort to track down the missing items. it stated that it was sheer negligence of the company that led to the TV going missing.

Agarwal Packers was ordered to pay Mr Barnwual Rs 28,000 along with the interest of 9 per cent per annum till the date of realisation. The company was also ordered to pay Rs 5,000 towards compensation and Rs 2,000 towards costs.
