Kerala High Court quashes QV ordered against ex-police chief K S Balasubramanian

The entire complaint was based on newspaper reports and not based on any reliable materials.

Kochi: Kerala High Court on Thursday quashed the Thrissur Vigilance Court order directing a preliminary inquiry against former State Police chief K.S. Balasubramanian for the alleged interference in the Hummer murder case in which Muhammed Nisham was an accused.

Justice B. Kemal Pasha quashed the order and observed that the entire exercise of the Vigilance Court was illegal. The vigilance court should not have absolved some of the respondents from the criminal liability and forwarded the complaint for quick verification or investigation besides, the vigilance court ordered quick verification only after taking cognizance of the offence.

The complainant had alleged before the Vigilance Court that media reports and details of the recorded conversations between a former DIG and the Thrissur city police commissioner, who was in charge of the investigation, would prove his charges. The former State Police chief argued that the vigilance court judge had no authority or jurisdiction to order such a preliminary inquiry on the complaint. The entire complaint was based on newspaper reports and not based on any reliable materials. The entire allegation of the complainant was false and frivolous, he said.
