Hyderabad Consumer Forum backs customer

The complainant returned the phone to the store on February 5 2016 telling them about the problem.

Hyderabad: The Hyderabad Consumer Forum – 3 has directed the Aptronix Park Lane, Secunderabad, store to refund Rs 35,500 to P. Prem Kumar who alleged that he had purchased an iphone from the store on January 3 2016 for Rs 25,500. The phone developed a problem with the screen and the scrolling speed. The complainant returned the phone to the store on February 5 2016 telling them about the problem.

Prem was given another piece on February 22 2016 but the box it was packed in did not have the I phone logo. The complainant was told not to worry. Prem was, however, not able to download anything from itunes since there was somebody else’s user ID and password already fed. Kondapur store staff said the phone was registered with someone else.

The complainant tried to check out with the store staff but they put the blame on Prem. The complainant sent the store a legal notice and also lodged a case with the consumer forum. The store replied to the notice of the forum saying that the complaint is not maintainable either in law or on facts. Also he is not a consumer within the meaning of consumer protection act.
