Hyderabad: Giving relief to the legal heirs of a petitioner, who had started the legal fight 23 years ago to retrieve from encroachers his 31 acres of land in Kandikal village of Bandlaguda Mandal, the Hyderabad High Court has held that the private respondents, or even third parties for that matter, have no semblance of right to remain in possession of the land in the light of the order of the Special Court conclusively adjudicating the right of the petitioners.
A division bench comprising Justice C.V. Nagarjuna Reddy and Justice D.V.S.S. Somayajulu, while delivering the verdict, observed that “the ingenuity of the encroachers on one side and indifference and lacklustre approach of the executive apparatus on the other side are mocking at the efficacy of the legal system.”
The bench also pointed out that “the private respondents herein are thriving on vexatious litigation frustrating the efforts of the successors of the original petitioner.”
The bench observed that the Majesty of Court lies in effectuation of its orders with promptitude and the executive on which this responsibility was consecrated cannot balk in discharging this function.
