Plea against allowing mere law graduates to compete for Civil Judge post

The notification makes a fresh law graduate, who has not been enrolled as an advocate, eligible to apply for the post of Civil Judge.

Chennai: A Public Interest Litigation has been filed in the Madras high court to quash a notification issued by the Tamil Nadu Public Service Commission, inviting applications for direct recruitment to the post of Civil Judge in the Tamil Nadu State Judicial Service, in so far as it allows mere graduates in law, who are not advocates to compete for the post.

A division bench comprising Justices V.Bhrathidasan and V.Parthiban before whom the PIL filed by advocate M.Radhakrishnan came up for hearing on Friday, posted it to April 28 for filing response by the state government TNPSC.

According to Radhakrishnan, the notification makes a fresh law graduate, who has not been enrolled as an advocate, eligible to apply for the post of Civil Judge. The said clause enabling mere law graduates who are not advocates, to apply for the post of Civil Judge was arbitrary, unreasonable, irrational and violative of Article 14 and 16 of the Constitution.
