4 doctors take on builders in Kozhikode

Flats not handed over even after 12 years.

KOZHIKODE: Four doctors here have initiated legal recourse against Pentagon Builders here for failing to hand over their properties even after 12 years since signing an agreement.

Dr Abdul Latheef, Dr M. M. Saleem, Dr K. Safarulla and Dr K. Abdul Muneer said they had submitted a petition against the builders to the city police commissioner.

They had booked four flats ranging from Rs 35 lakh to Rs 60 lakh in its Seashell luxury apartments on Kamburam beach in 2007.

As per the agreement, the delivery was to be by 2012.

Its construction began in 2009, but even after registration of the flats on May 29, 2018, their transfer is still pending.

Without their knowledge, Pentagon availed a loan of Rs 5 crore from Kerala Financial Corporation by pledging the property, which they came to know when they received a notice demanding Rs 7.5 crore to clear the debt.

As Pentagon failed to pay up, the flats failed to get electricity and gas connection for the pledged property.

"We are denied occupancy certificate and there is a deficiency in the floor area as per the agreement," said Dr Lathif.

Even though a petition was filed at Nadakkavu police station, there was no action.
