Real Estate Bill is effective: Karnataka High Court ex-judge

There is nothing in the act which talks about that, says Rajagopalan.

Bengaluru: “The Real Estate (Regulation and Development) Act 2016 is a comprehensive, effective and powerful act. Till the real estate authority and the Appellate Tribunal are established, somebody needs to be appointed by the appropriate government,” said Justice A.V. Chandrashekara, former judge of the Karnataka High Court while speaking at 'Namma Hakku', an event organised by the Namma Bengaluru Foundation (NBF) on citizens’ rights, in the city on Saturday.

He said, “I don’t know whether the Karnataka government has appointed the principal secretary of the housing and urban development department as the regulatory authority. One year was given from March 23, 2016 when it was officially gazetted by the central government. But till the Real Estate Regulatory Authority is set up, the government is expected to appoint somebody. Probably, the government has not seen the rule and organisers of this event should bring it to the notice of Law Secretary, who is a judiciary officer in the government. I think a suitable notification will come."

Prof. Rajagopalan, citizen activist and fellow, IIM-Ahmedabad,said, "Unless there is a provision for action against colluding approval authorities, things are not going to be easy. There is nothing in the act which talks about that."

Mr Rajeev Chandrasekhar, MP and Founder Trustee of Namma Bengaluru Foundation, said, “We have to stop begging our elected leaders and administrators to do what is the city’s right. In some sense, tell them it is our right to have these things done for our city.”
