Supreme Court refuses to order probe into Acharya allegations

The High Court dismissed the petition as of no merits.

New Delhi: The Supreme Court on Monday refused to entertain a special leave petition seeking initiation of probe into the allegations levelled by B.V. Acharya, former Karnataka Special Public Prosecutor in his autobiography that he was pressurised during the trial of the Rs 66 crore disproportionate assets case involving the former Tamil Nadu Chief Minister Jayalalithaa, Sasikala, Ilavarasi and Sudhagaran. A Bench of Justices Pinaki Chandra Ghose and Rohinton Nariman dismissed as 'no merits' the SLP against a Karnataka High Court order rejecting a similar plea. It must be noted that the apex court had on June 7 reserved the judgment in the DA case.

The petitioner M. Rathinam had filed a writ petition in the Karnataka High Court for a probe into the serious allegations of senior advocate Mr. Acharya that there was tremendous pressure on him from Ms. Jayalalithaa and TN government during the trial. The High Court dismissed the petition as of no merits.

He said the High Court had not gone into the merits of the allegations which warrant a detailed probe. He sought quashing of the HC verdict and a direction to order a fresh probe into issues raised by Mr. Acharya in his book.
