Amend motor vehicle accident rules, says Madras High Court

Tamil Nadu police can take pride that TN is the first and only state as on date in implementation of the online DAR regime.

Chennai: The Madras high court directed state government to amend the TN Motor Vehicle Accident Rules, 1989, in line with the newly developed online Detailed Accident Report regime as mandated by the Supreme Court.

When the matter came up for hearing before Justice P.N. Prakash, the authorities submitted that the online version of Detailed Accident Report (DAR) was now fully functional, providing access to the victims and all stakeholders and enabling them to access crucial documents and investigation reports relating to the accident and pursue a claim for compensation. The reports can be downloaded at Rs 10 per document.

“The online DAR adds a feather to the cap of the state crime record bureau (SCRB) for not only conceiving this facility but ensuring its implementation without any time overruns as well. Tamil Nadu police can take pride that they have met the mandate of law and lead the way as the first and only state as on date in implementation of the online DAR regime,” said Justice P N Prakash.

Recording the report, the judge directed state government to make amendments to the Tamil Nadu Motor Vehicles Accident Claims Tribunal Rules, 1989, to give legal backing to the online platform. As per DAR procedure, police are required to immediately register an FIR regarding the accident, identify the victim, vehicle, owner of the vehicle, obtain the registration certificate, driving licence, permit, insurance policy, injury or death records of the victims, then compile a comprehensive report of all the details with all authenticated documents of the victim’s claim.
