Chennai: The Madras high court ordered notice to the Election Commission of India on a petition seeking to quash a communication of ECI refusing to register his proposed political party namely “J.Jayalalitha Party” in short “JJ Party”. Justice Pushpa Sathyanarayana posted after four weeks, further hearing of the petition filed by one P. A. Josseph.
According to petitioner, he was formerly member of the AIADMK party. He wanted to start a political party in her name and wanted to continue her visionary and objectives to the fullest. As per the guidelines, the bylaws were passed and as a founder president of the proposed political party, namely J.Jayalalitha party in short JJ Party, he had submitted his application on March 13, 2018 along with all the necessary documents as per the guidelines issued by the ECI.
Afterwards, he gave several clarifications sought for by the ECI. However, the ECI had on August 21, 2018 informed him that his party’s name - “JJ Party” - needs to be expanded and it should not be in abbreviation form. He clarified that the “JJ Party” was the one which was short form of “J.Jayalalitha Party”, he added.
He said as per section 29 of the Representation of people Act, the name of the party should not contain religion or caste and the proposed party name should not be already registered. Other than these three restrictions, there was nothing under the RPA which bars the name of political party with that of a national leader who had already passed away. But, to his shock and surprise, the ECI had rejected his request to register his party, he added.
