Hyderabad HC tells Telangana to adhere to rules

Petitioner counsel alleged that the authorities granting licences to applicants without verifying their efficiency on the test track.

Hyderabad: The Hyderabad High Court on Monday directed that the transport authorities in TS to grant licences in accordance with the law and directed that the state transport commissioner to file a sworn affidavit assuring the court that no deviations will allowed in doing so.

A division bench comprising Acting Chief Justice Dilip B. Bhosale and Justice P. Naveen Rao was dealing with a petition by Road Craft Society, an NGO, seeking strict implementation of the rules prescribed in Central and State Motor Vehicles Act while granting driving licences.

Counsel appearing for the petitioner alleged that the authorities were granting licences to applicants without verifying their efficiency on the test track. Authorities were conducting the test as a matter of routine and granting licenses, counsel said.

While agreeing with the contention of the petitioner, the bench said driving a vehicle efficiently on the testing track is not enough to judge the capability of the applicant and authorities would have to thoroughly observe whether the applicant is capable to drive or not.

When the bench sought the response from counsel for TS, he sought time to submit all relevant rules. Pointing out that there was a dire need of strict implementation of the Rules in view of the increase in fatal road mishaps, the bench adjourned the case.
