Tamil Nadu: Discharge plea by HM chief murder accused dismissed

A gang assaulted Suresh Kumar, Tiruvallur district unit chief Hindu Munnani, with deadly weapons on June 18, 2014, at 9.30 pm.

Chennai: The principal district and sessions Court, Tiruvallur, has rejected a petition filed by an accused in murdering Tiruvallur district chief of Hindu Munnani to discharge him from the case. A gang assaulted Suresh Kumar, Tiruvallur district unit chief Hindu Munnani, with deadly weapons on June 18, 2014, at 9.30 pm. They attacked Suresh Kumar when he was walking on Chennai to Tiruvallur High road, Mannurpet. Suresh Kumar, who sustained more than a dozen cut injuries, was rushed to a hospital where he died, said special public prosecuto, C.S.S. Pillai.

Ambattur Estate police registered a case and identified that members of Muslim Orunginappu Peravai (MOP) developed animosity against Suresh Kumar for his activities in the Hindu Munnani. Following an investigation, the police arrested members of MOP - Abdullah Muthalif of Mannadi and others. Pillai said the fundamentalist organisation aimed at wiping out Suresh Kumar. The group conducted several meetings in MOP office on Masudi Street, Padi, Mannadi, Nagarkoil, Vaniyambadi and Tirupur from December 2013 to June 2014. Ambattur Estate police station recently filed chargesheet before the court.

In discharge petition, Abdullah Muthalif, submitted that there was no prima facie evidence against him in the charge sheet and the prosecution had not established any incriminating evidence against him. There was no specific allegation against him and cops not seized weapons from him. Based on a false allegation the police filed the charge sheet. Hence, he sought the court to discharge him from the case.

However, the prosecution replied that trial was in the initial stage of framing charges and collecting evidence from prosecution witnesses not commenced. Concurring with the contention of the SPP, the special judge has dismissed the petition filed by Abdullah Muthalif. The trial will commence from Friday.
