Former High Court judge Justice M.F. Saldanha has again hit back at Upalokayukta Justice Chandrashekaraiah, saying it was the latter’s track record in question and not anyone else’s.
“He has said I am frustrated as I have no job and hence I have been writing letters. I agree that I have no job and that is why I am writing letters in public interest. Pointing fingers at my track record will have no relevance as I am not the upalokayukta, it is he who is Karnataka’s Upalokayukta,’’ Justice Saldanha said on Wednesday.
He said there is nothing confidential about the letter he wrote to the governor on the appointment of Justice Chandrashekaraiah as the Upalokayukta. “An unprecedented situation prevails in the state on the illegal appointment of Upalokayukta. Whatever orders he passes and action he initiates as Upalokayukta might well be turned invalid if the High Court sets aside his appointment. The other allegations I have stated in my letter to the governor are irrelevant, for the very appointment of Upalokayukta doesn’t hold any legal efficacy,” he said.
Asked about Justice Chandrashekaraiah’s statements against him, Justice Saldanha said, “The Roost Resort incident and other issues I highlighted in my letter to the governor were not considered at all. The procedure followed in selecting former judges for the post of Lokayukta and Upalokayukta is invalid. How can the Chief Justice, who in all probability would be serving in the state for the first time in his judicial service, be aware of the track record of a judge who worked in the High Court some years ago? In the present instance, Justice Vikramjit Sen was a judge in Delhi High Court and it is the duty of the government to give a list of names, so that the CJ can take confidential opinion and suggest a name,’’ he said.
