Andhra Pradesh government has promoted several juniors into DG rank

Hyderabad: The Hyderabad bench of the Central Administrative Tribunal (CAT) on Friday reserved its orders on a petition by senior IPS officers S.A. Huda and TP Das, challenging the decision of the erstwhile AP government to promote the Telangana DGP Anurag Sharma to the rank of DGP (HAG scale).

The AP government on April 1, 2014 issued order promoting Anurag Sharma to the rank of DGP (HAG scale). A two member bench comprising B. Venkateswara Rao (judicial) and Ms Ranjana Chowdary (administration) was hearing the case.

Mohammad Shafiquzzaman, counsel appearing for the petitioners argued that since the action of the government contrary to the IPS cadre and pay rules, all the subsequent actions of Telangana state and UPSC in making Sharma as the DGP (head of police force, HOPF) of Telangana have to be cancelled.

The Andhra Pradesh government has promoted several juniors into DG rank when there were no vacancies in the DGP rank posts, despite the directions of the tribunal and High Court the state cannot create ex-cadre posts in the rank of DGP beyond the permissible level.

J Ramachandra Rao additional advocate general of Telangana and Raghunandan Rao, counsel appearing for Anurag Sharma contended that the petitioner SA Huda cannot challenge the appointment of the DGP of a neighbouring state, since he has been allocated to AP cadre post bifurcation. They said that the promotion and appointment of Anurag Sharma as DGP was in accordance with the law.
