Madras HC asks TN govt to consider PIL plea for uploading FIR copy

Accused had to apply through Judicial Magistrate court to get a copy of FIR

Madurai: The Madras High Court Bench on Monday directed Tamil Nadu government to consider uploading in the police website copies of first information reports (FIRs) within 24 hours of their registration in respective police stations, as sought by a PIL litigant.

A bench, comprising Justice R.Sudhakar and Justice V M Velumani, directed the state Director General of Police and the Home Secretary to consider the plea of the petitioner within two months.

Petitioner V.Kasirajan, an advocate and a Public Interest Litigation activist, submitted that police did not follow the rule that FIR copy should be provided within 24 hours to the accused, denying their basic right. The accused also face problem in getting bail.

The accused had to apply through the Judicial Magistrate court to get a copy of the FIR, which took two days.

Hence, the court should issue a direction to the officials of the respective police station to upload the FIR registerd against a person within 24 hours after the registration of the case so that the same could be downloaded.
