How to better collegium, Supreme Court asks

The Supreme Court on Tuesday sought suggestions from senior advocates
New Delhi: In a new development in the NJAC case, the Supreme Court on Tuesday sought suggestions from senior advocates Fali Nariman, Ram Jethmalani, Anil Divan and others as to how the collegium system of judicial appointments can be improved to take care of the criticism that the system was not transparent.
A five-judge Constitution Bench comprising Justices J.S. Khehar, J. Chelameswar, Madan B. Lokur, Kurian Joseph and A.K. Goel, hearing a batch of petitions questioning the validity of NJAC and the constitution amendment laws, made this suggestion after Mr Jethmalani said “the intention is to overrule the nine-judge Bench decision giving primacy to the CJI and the collegium and the NJAC Act was mischievous.
He said the intention of the present NDA government was to derogate the powers and primacy of the Chief Justice of India in appointment of judges and to give primacy to the executive. Justice Khehar told Mr Jethmalani and Mr Nariman “If we accept your arguments and strike down the NJAC law, then we may have to restore the collegium system. We want suggestions how it can be strengthened. Alternatively, if we reject your arguments and uphold the validity of the NJAC law, but read down certain provisions, then tell us how the provisions can be read down within the parameters of the basic structure of the Constitution.”
