Madras High Court shifts onus to Andhra Pradesh High Court

Court asked one of the relatives of the deceased to approach the Hyderabad High Court

Chennai: Refusing to order a re-postmortem on the bodies of six men who were shot dead in Sesachalam forest by the Andhra Pradesh police, the Madras High Court on Monday ordered one of the relatives of the deceased to approach the Hyderabad High Court (for remedy in this regard) which is already hearing the case.

Disposing of a public interest litigation filed by wife of one of the victims from Tiruvannamalai, the second bench of HC, comprising justices Satish K Agnihotri and M. Venugopal said, “Since judicial discipline and propriety required that if the whole/entire cause of action had arisen in respect of the subject matter in issue before a High Court, which was also seized of the matter, the other High Courts may keep their hands off from interfering with the matter.”

Therefore, “we are not inclined to make any observation or pass any orders at this stage, reserving liberty to the appellant to approach the High Court at Hyderabad in the pending writ petition/Public Interest Litigation for a directing as required under Law,” the judges reasoned.

Petitioner Muniammal, wife of deceased Sasikumar of Vettagiripalayam, moved an appeal before the second bench praying for direction to the authorities to conduct a fresh autopsy on her spouse’s body and pay adequate compensation.
