HC division: Telangana places 3 options for bifurcation

The options are for separation of existing common HC for AP and Telangana

Hyderabad: The Telangana state government on Tuesday placed three options before the Hyderabad High Court for separation of the existing common High Court for AP and Telangana state.

Telangana Advocate-General K. Ramakrishna Reddy, advancing the arguments before a division bench comprising Chief Justice Kalyan Jyoti Sengupta and Justice P.V. Sanjay Kumar, said that every state is entitled to have its own HC.

Recalling the agitations of advocates, he said the TS government is ready to provide the infrastructure for the smooth functioning of separate AP HC in Hyderabad. He submitted that the government has already informed the Centre that it is prepared to provide separate building for the High Court of TS at Gachibowli in the event if it is proposed to accommodate AP High Court in the existing building.

He told the court that the government was also prepared to accommodate separate HCs by providing additional infrastructure facilities if the President notifies the principal seat for AP High Court at Hyderabad as per the provisions of the Reorganisation Act.

The AG also said that TS was ready to provide the new building at Gachibowli for the AP HC if the AP government desires. The Centre, in an affidavit, made it clear that the selection of the location of a new HC of AP is the responsibility of the state government in consultation with HC.

Reacting to the submissions of the AG, the bench said that it has to be examined whether the Union of India has a duty in this regard.
