Hyderabad high court quizzes advocate general on MLCs

Petition filed seeking disqualification of rebels

Hyderabad: Justice Vilas V. Afzulpurkar of the Hyderabad High Court on Tuesday asked the advocate-general of Telangana to appear next Tuesday to hear a petition seeking suspension of five MLCs of the Congress who joined the Telangana Rashtra Samiti.

The judge was dealing with a petition by Telangana Congress whip M.S. Prabhakar Rao seeking to declare as illegal the inaction of the chairman of the Telangana Legislative Council in not fixing a date for hearing his application moved for disqualification of the MLCs.

The petitioner submitted that K.R. Amos, V. Bhoopal Reddy, N. Rajalingam, T. Bhanu Prasad Rao and S. Jagadiswar Reddy, who were elected as MLCs of the Congress, have joined with the TRS and the action of the five MLCs is liable for disqualification for defecting to another party.

He contended that as per the law, an elected member of a political party has to submit his resignation to his primary membership and to the post he holds before joining another party.

He said that as they joined the TRS without resigning from the party and MLC post, he had moved an application before the chairman of the Council seeking their disqualification.

The petitioner submitted that as per law, after receiving the application for disqualification of a member, the chairman has to fix a time frame and conclude proceedings within three weeks and pass appropriate orders.

He said he had filed the application on June 1, 2014 and till date the hearing was not started by the chairman and urged the court to fix a date for hearing and direct chairman to decide his application and thereafter conduct the proceedings on day-to-day basis if need be.

Meanwhile Telangana TD leaders have also decided move the court seeking to declare the action of the Speaker of Telangana Assembly in not disqualifying T. Srinivasa Yadav, T. Krishna Reddy and Dharma Reddy as illegal.

Narsapur MLA gets HC notice

A division bench of the Hyderabad High Court comprising Chief Justice Kalyan Jyoti Sengupta and Justice P.V. Sanjay Kumar on Tuesday issued notices to B. Madhava Naidu, MLA of Narsapur constituency in AP asking him to explain why proceedings should not be initiated against him for contempt of courts.

The bench had initiated suo motu contempt proceedings against him after the perusing a report of additional district judge, Narsapur with regard alleged interference in demolition of some buildings as per court orders of the court. While issuing the notice, the bench adjourned the case to February 3.
