Madras High Court fines Tamil Nadu Rs 10,000 in mining probe issue

Court expressed its displeasure ver the non-implementation of its order
Chennai: The Madras high court dismissed a review petition filed by the Government and imposed a cost of Rs 10,000. The court expressed its displeasure in no uncertain terms over the non-implementation of Madras high court order by the government in connection with the appointment of U. Sagayam, IAS, former Madurai district collector and vice-chairman, Science City, as a special officer / legal commissioner, to conduct a probe various types of mining activities and submit a report to the court within two months.
When the review petition filed by the state chief secretary came up for hearing before the first bench comprising Chief Justice, Sanjay Kishan Kaul and Justice M. Sathyanarayanan, the bench directed the government to do the needful as requested by Mr Sagayam within four days from today. “If Sagayam feels any impediment and lack of assistance from the State government, he is at liberty to move the court”, the bench said and adjourned the hearing on the original PIL filed by social activist ‘Traffic’ K.R. Ramasamy to Dec. 22.
Originally, Ramasamy, in a PIL, sought direction to Union and state governments to launch prosecution against illegal mining operating in Tamil Nadu. The bench comprising Chief Justice Sanjay Kishan Kaul and Justice Pushpa Sathyanarayana, on Sept. 11, gave the direction while closing an interlocutory application filed by Ramaswamy, which sought a direction to appoint Sagayam to inspect the illegal mining.
