Hyderabad High Court ends hearing on PIL against state GO

Hyderabad: A division bench comprising Chief Justice Kalyan Jyoti Sengupta and Justice P.V. Sanjay Kumar of the Hyderabad High Court on Tuesday reserved its orders on petitions challenging an Ordinance issued by the Telangana state government to terminate the chairpersons and members of agricultural market committees in the state.

The bench was concluding the hearing on the plea by M. Tirupathi Rao and six other chairmen of various agricultural market committees challenging the Ordinance issued to terminate them.

Sarasani Satyam Reddy, senior counsel appearing for the petitioners, contended that there was no situation that warrants of emergency to issue an Ordinance to terminate the existing committees without expiry of their tenure.

K. Ramakrishna Reddy, advocate general of Telangana, contended that the government has absolute power under Article 213 to issue an Ordinance to terminate the committee as they are not elected bodies.

He said the government has already appointed a person in charge to the existing agricultural market committees and terminated the existing committees pursuant to the Ordinance issued on August 16, 2014.

He submitted that as the petitioners not to choose to challenge the consequential action of the government there was no point in hearing the petition.
