Vaiko gets reprieve in POTA case

Thirumangalam police, filed a chargesheet under Section 21 of POTA

Chennai: In what has come as major relief to MDMK leader Vaiko, the Madras high court has set aside the order of a special court which had rejected the plea of the state public prosecutor to withdraw a case registered against Vaiko under the Prevention of Terrorism Act (POTA).

On December 30, 2002, the Thirumangalam police, Madurai, filed a chargesheet against Vaiko and others for offences under Section 21 of POTA and the special court commenced the trial against them.

Based on a direction from the Centre, the state directed the public prosecutor to file an application under Section 321 of the CrPC, seeking sanction to withdraw the case. However, the special court in 2004 rejected the plea.

When the matter came up before SC on March 3, the apex court remitted the case back to the HC.
