PIL against Cheyyur mega power project dismissed

PIL challenged land acquisition proceedings of the state government
Chennai: The Madras high court has dismissed a public interest litigation challenging land acquisition proceedings of the state government for the 4,000MW Ultra Mega Power Project in seven villages of Cheyyur Taluk in Kancheepuram district.
A division Bench comprising Chief Justice Sanjay Kishan Kaul and Justice M. Sathyanarayanan dismissed the PIL filed by Mr K. Saravanan.
The Bench said the environmental issue relating to the establishment of 4,000MW Ultra Mega Power Plant and Ash Dyke and also Captive Port in the seven villages of Cheyyur Taluk was receiving the attention of the National Green Tribunal and the petitioner had filed the petition claiming that there could not be any acquisition proceedings as the environmental issue was before the Tribunal.
“We are informed that the acquisition proceedings in the present case started in May 2010 and the land owners have been called upon to appear and collect the compensation in September, 2013, and 31 persons have already received compensation. In view of the aforesaid position, the plea of the petitioner that in larger public interest, the acquisition proceedings cannot go on (which are substantially complete), on the ground that the issue of location of the power project inter alia is before the Tribunal could not be permissible, nor in our view, a PIL in this form be entertained by a person who does not even have any interest in the land in question sought to be acquired,” the Bench said.
