Hyderabad: The Hyderabad High Court on Thursday directed the APNGOs Mutually Aided Cooperative Housing Society to submit the details pertaining to the funds required to run its day-to-day affairs.
Justice Nooty Ramamohana Rao was dealing with a writ petition by the Society, challenging the action of the police in directing the bank authorities to freeze its account, based on a complaint by the district cooperative officer for alleged violation of provisions of the AP Mutually Aided Cooperative Societies Act.
Advocate appearing for the Society submitted that the functioning of the Society including payment of salaries to the employees and day-to-day expenditure was adversely effected in view of freezing of its bank account in September 2013. The counsel for the home department submitted that the petitioner’s affidavit lacks information regarding the amount available in the bank account and the amount required to meet the Society’s expenditure, including salaries and payment of statutory taxes.
The judge then directed the petitioner Society to file an additional affidavit mentioning the bank details and the required expenditure and adjourned the case to Monday. Meanwhile, about 25 Society members, who have impleaded as parties to the petition, opposed defreezing of the bank account alleging that the management of the Society would resort to misuse the money. Justice B. Shiva Shankar Rao of the High Court at Hyderabad on Thursday granted conditional bail to Sanjeev Shaw, former finance director of BMW India Ltd, and Vikrant Singh, current marketing head of the company, in a criminal case lodged by car dealer Viren Choudary.
The judge directed that both the petitioners furnish two sureties of '50,000 each and surrender before the concerned magistrate. The magistrate is to grant normal bail not later than 24 hours of their application.
The judge made it clear that in the event of the police making out a case for police custody, for the purpose of interrogation, the petitioners shall be taken into custody which shall not exceed 24 hours each.
