Confusion over December 16 rape hearing in Supreme Court

The court said that “exemplary punishment” was needed for the convicts

New Delhi: On Monday, there was confusion when the pleas of convicts in the gruesome December 16 gangrape-murder case Vinay and Akshay came up for hearing before a bench of Justices Ranjana Prakash Desai and N.V. Ramana.

The bench queried if it could hear the applications in light of the observation made by Chief Justice R.M. Lodha that cases of death convicts should be heard by a bench of not less than three judges.

The bench called for the Supreme Court registrar, who said no such notification had been issued.

The Delhi High Court had on March 13 upheld the conviction and death penalty awarded to the four convicts, terming the offence “extremely fiendish” and “unparalleled in the history of criminal jurisprudence”.

The court had said that “exemplary punishment” was needed for the convicts.
