CBI is reluctant to share ‘case diary’ of Ishrat Jahan fake encounter case with MHA

New Delhi: A fresh tussle seems to be in the offing between the Union home ministry and the CBI with the latter expressing its reservation over the issue of sharing its ‘case diary’ pertaining to the Ishrat Jahan fake encounter case, involving former IB officials, as required by the ministry.

The agency has sought legal opinion over the issue amidst the possibility that the move will further delay the CBI's decision to prosecute IB officials in the case.

“The CBI’s contention is that sharing the case diary with the MHA would be against the principles of the CrPC. Under section 172 of the CrPC, 1973 the probing officer, after concluding its probe, files it final report before the magistrate only,” a source said.

“In the cases where sanction for prosecution of an official is sought from the government the CBI provides the sanctioning authorities with details of the case. We also have meetings with them to explain our case. It is strange that the Union home ministry is seeking the case diary in this case. We have sought legal opinion on the issue”, sources added.
