President's rule to be re-imposed in Andhra Pradesh, assembly dissolved

President's rule was imposed on March 1, was lapsing on April 30
Hyderabad: The Union Cabinet, which met for an hour on Friday evening, took stock of the situation in the state, which is presently under President Rule, and discussed the modalities to overcome some of the Constitutionalities involved in extending the President Rule beyond April 30.
The President Rule, which was imposed on March 1, will automatically lapse on April 30, in the absence of ratification by both the Houses of Parliament which was mandated by the Supreme Court in the S.R. Bommai case.
The Union Cabinet felt that since Parliament can’t be summoned at this stage for ratification, it would be better to get the President Rule to lapse on April 30. It also decided to recommend to the President dissolution of the Assembly and reimposing President Rule from April 30.
Solicitor-General of India Mohan Parasaran said that “since there were no prospects of forming a popular government at this stage and the state was going for general polls, the President can dissolve the Assembly and reimpose President Rule from April 30”.
Mr Parasaran also said that as per the provisions of Art 356 (1) (C), the President is empowered to dissolve the House. Normally, it is in the Governor’s power to dissolve the House as per Art 174. But in special circumstances, “the President can go ahead with both dissolution and reimpose President Rule”.
He also confirmed that Governor E.S.L. Narasimhan had sent a report to the Union Cabinet recommending dissolution and reimposing President Rule citing “no prospects to install a popular government at this stage as the state is in the midst of general elections.”
